Legal — binding
Terms of Sale
These are the real terms that govern a purchase from FACECRIME. They sit alongside the Terms of Surrender, which is a work of satire and has no legal effect. Where the two appear to disagree, this document is the one that counts.
⚠ Placeholders below must be completed before the shop opens.
Fields marked […] require the trader's real legal identity and are a
legal requirement for distance selling in the EU. Selling with these unfilled is
not compliant.
1. Who you are buying from
- Trader
- [REGISTERED LEGAL NAME]
- Trading as
- FACECRIME
- Registered address
- [STREET, CITY, POSTCODE, COUNTRY]
- Company number
- [REGISTRATION NUMBER]
- VAT number
- [VAT ID, or "not VAT registered"]
- Contact
- [ORDERS@DOMAIN]
2. These are pre-orders
Every item in Vol. 1984 is sold as a pre-order. At the time you pay, the garment has not yet been manufactured. You are paying in advance for an item that will be produced and then dispatched to you.
Payment is taken in full at checkout. This is disclosed before you pay, on the product page and at the checkout screen.
3. Delivery
- Dispatch window
- Within 30 days of your order being placed.
- Territory
- European Union only. We do not ship outside the EU.
- Shipping cost
- Included in the price. There is no separate charge.
If we cannot dispatch within 30 days, we will contact you and offer either a revised date or a full refund. If you do not accept a revised date, you are entitled to cancel and receive a full refund without penalty.
Risk passes to you on delivery. If an item arrives damaged, tell us within a reasonable period and we will replace or refund it.
4. Your right to change your mind
Under EU consumer law you have a right of withdrawal. You may cancel this contract within 14 days without giving any reason. The period runs from the day you (or a third party you nominate) take physical possession of the goods.
To withdraw, send a clear statement to [ORDERS@DOMAIN] — an email saying you are cancelling is enough. You do not need a form or a reason. To meet the deadline it is sufficient that you send your communication before the 14 days expire.
You may also cancel at any point before dispatch, including during the pre-order production period.
Effects of withdrawal
We will reimburse all payments received from you without undue delay and not later than 14 days from the day we are informed of your decision. We will use the same means of payment you used, and you will not be charged any fee for the refund. We may withhold reimbursement until we have received the goods back, or until you supply evidence of having sent them, whichever is earlier.
You must send the goods back without undue delay and in any event not later than 14 days from the day you communicate your withdrawal. You bear the direct cost of returning the goods. You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the item.
5. Legal guarantee
Separately from the withdrawal right, you have a legal guarantee of conformity. If an item is faulty, not as described, or not fit for purpose, you are entitled to repair, replacement, price reduction or refund under EU law. This applies for a minimum of two years from delivery and is not affected by anything in these terms.
6. Price and payment
All prices are in euro and shown inclusive of any applicable VAT. Every piece in Vol. 1984 is €19.84 — the figure is the point, not a promotion.
Payment is processed by Stripe. We never see or store your full card details. See Stripe's privacy notice for how they handle payment data.
7. What we do with your data
To fulfil an order we collect your name, delivery address, and email address. We use them to make and send your order, and to contact you about it. We keep order records for as long as tax and accounting law requires, and no longer.
We do not sell your data, we do not profile you, and we run no advertising trackers. The site itself sets no cookies and loads no third-party analytics. Under the GDPR you may request access to, correction of, or erasure of your data by writing to [ORDERS@DOMAIN].
8. Complaints and disputes
Write to [ORDERS@DOMAIN] first and we will try to resolve it. If we cannot, EU consumers may use the European Commission's Online Dispute Resolution platform. Nothing here removes your right to bring proceedings in the courts of your country of residence.
9. Nature of the product
FACECRIME is an art project that sells a real, physical garment. The garment is a knitted balaclava with embroidered lettering. It is a piece of clothing and a piece of commentary. It is not protective equipment, it is not a privacy device, and it makes no claim to defeat any specific technology. Buy it because you want the object.
FACECRIME is an independent project and a work of parody and criticism. It is not affiliated with, sponsored by, or endorsed by any technology company. Third-party names appear nominatively, for commentary.
